Customers who use and shop on this e-commerce site are deemed to have accepted the following terms:
The web pages on our site and all linked pages (the "Site") are the property of and operated by Onywatch Rüya Saatçilik San. Ve Tic. Ltd. Şti (the "Company"), located at Kavaklıdere Mah. John F. Kennedy Cad. No:13/8 Çankaya, Ankara, TURKEY. While using all the services offered on the Site, and by continuing to use and benefit from these services, you (the "User") agree that you are subject to the following conditions; that you have the right, authority, and legal capacity to enter into a contract under the laws applicable to you; that you are over 18 years of age; and that you have read, understood, and are bound by the terms and conditions written in this agreement.
This agreement imposes rights and obligations on the parties regarding the Site that is the subject of this agreement. Upon accepting this agreement, the parties declare that they will fulfill the aforementioned rights and obligations completely, accurately, on time, and within the conditions stipulated herein.
1. RESPONSIBILITIES
a. The Company reserves the right to make changes to prices and the products and services offered at any time.
b. The Company accepts and undertakes that the member shall benefit from the services subject to the contract, excluding technical malfunctions.
c. The User accepts in advance that they will not reverse engineer the Site or engage in any other action aimed at finding or obtaining its source code. Otherwise, they will be held liable for any damages incurred by third parties, and legal and penal proceedings will be initiated against them.
d. The User agrees not to produce or share content in their activities on the Site, in any part of the Site, or in their communications that is contrary to general morality and decency, unlawful, infringes upon the rights of third parties, misleading, aggressive, obscene, pornographic, violates personal rights, infringes on copyrights, or encourages illegal activities. Otherwise, they are solely responsible for any resulting damages. In such cases, the "Site" authorities reserve the right to suspend or terminate such accounts and initiate legal proceedings. For this reason, the Company reserves the right to share information if requests regarding user accounts or activities are made by judicial authorities.
e. The relationships of the Site's members with each other or with third parties are their own responsibility.
2. Disclaimer of Warranty: THIS CLAUSE OF THE AGREEMENT SHALL APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. THE SERVICES PROVIDED BY THE COMPANY ARE OFFERED ON AN “AS IS” AND “AS AVAILABLE” BASIS. THE COMPANY MAKES NO WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE CONCERNING THE SERVICES OR THE APPLICATION (INCLUDING ALL INFORMATION CONTAINED THEREIN), INCLUDING BUT NOT LIMITED TO ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
3. Force Majeure: If the obligations arising from the agreement become impossible for the parties to perform due to reasons beyond their control, such as natural disasters, fires, explosions, civil wars, wars, riots, civil commotions, declarations of mobilization, strikes, lockouts, epidemics, infrastructure and internet failures, or power outages (hereinafter collectively referred to as "Force Majeure"), the parties shall not be held liable. During this period, the rights and obligations of the Parties arising from this Agreement shall be suspended.
4. Registration and Security: The User must provide accurate, complete, and up-to-date registration information. Otherwise, this Agreement will be considered violated, and the User's account may be closed without prior notice.
The User is solely responsible for their password and account security on the site and third-party sites. The Company cannot be held liable for any data loss, security breaches, or damage to hardware and devices that may otherwise occur.
5. Confidential Information: 5.1. The Company will not disclose the personal information transmitted by users through the site to third parties. This personal information includes any details intended to identify the User, such as name and surname, address, phone number, mobile phone number, and e-mail address, and shall hereinafter be briefly referred to as 'Confidential Information'.
5.2. The User accepts and declares that they consent to the company owning the Site sharing their contact, portfolio status, and demographic information with its affiliates or affiliated group companies, strictly limited to use within the scope of marketing activities such as promotions, advertisements, campaigns, announcements, etc. This personal information may be used within the company to determine customer profiles, offer promotions and campaigns tailored to the customer profile, and conduct statistical studies.
